2 unknown males, born 1810-1820

3. 1820, 27 Feb: Richard Upshaw marries Rebecca Elder in Elbert Co, GA;

Test: Austin Webb, Reuben Christian, J.P. Recorded 20 June 1822. This quit claim was delivered to me for record in lieu of an original warrantee deed which was said to be lost, but afterwards was found & delivered to me for record also & which is recorded in folio 33 of this book. (signed) B. Houston, clk. (Martin, page 56).

5. 1822, 8 May: (Elbert Co., Ga., Deed Book T, page 28):

(signed) Richard (x) Upshaw. Wit: Gabriel Booth, Reuben Christian, J.P. Recorded 20 June 1822, B. Houston, clk. (Farmer, page 56).

6. 1822, 8 May: Richard Upshaw buys 100 acres in Walton Co, on Shoal
Creek, Lot no. 42; (Walton Co, GA, deed book E, page 45).

7. 1826: Richard Upshaw reports 100 acres in Walton Co, on Rocky Creek,
Lot no. 42; Walton Co, GA, tax digest, 1826, Capt. Henderson's Dist.

8. 1830 census, Walton Co, GA, page 158:
Richard Upshaw, born 1780-1790 (this is evidently Richard "Sr.")
unknown male, born 1815-1820
female, born 1800-1810 (this could have been Rebecca (Elder) Upshaw,
as Richard Upshaw Jr. was gone, as he did not report his own taxes
in 1831)
unknown female, born 1810-1815.
unknown female, born 1815-1820
(note that all the following children could be the children of
Richard & Rebecca (Elder) Upshaw):
2 unknown females, born 1821-1825
unknown male, born 1826-1830 (this could be Alexander Wilson Upshaw)
unknown male, born 1826-1830

9. 1831: Elisha Henderson, AGENT FOR Richard Upshaw, reports 100 acres in
Walton Co, on Hard Labor Creek, Lot no. 42; Walton Co, GA, tax digest,
1831, Capt. Henderson's Dist. NOTE: This, in part, answers the
question as to Richard Jr's whereabouts in the 1830 census, in that he
was NOT in Walton Co, as he did not report his own taxes; this also
proves that it was Richard Jr. who was the owner of this, as Richard
Sr. was there in 1830 and did not report (see census, note 7, above).

10. 1832: Richard Upshaw of Walton Co, Capt. Alberson's district, drew land in Bartow Co, GA, lot #95, dist 4, sect 3, which was granted on 24 May 1833
Source: 1832 Cherokee Gold Lottery. (this is presumed to be Richard Jr) (There has never (yet) been found any record of Richard Upshaw in
Bartow Co, GA)

Walton Co, GA, tax digest, 1834, Capt. Henderson's Dist.

13. 1840 census, Walton Co, GA, page 120:
(NOTE: this census curiously shows NO children born between 1830 & 1840)
Richard Upshaw, born 1800-1810 (was this Richard Upshaw, Jr?; this
was the only male in the household, so THIS Richard was younger
than the older Richard in the 1820 & 1830 censuses).
unknown female, born 1780-1790 (was this widow of Richard Sr? but,
if so, where was she in 1830; this could have been the mother of
Rebecca Elder)

unknown female, born 1810-1820
unknown female, born 1820-1825

COMMENTS:

1. Children are assigned to this family with the assumption that only the
children born after 1820 listed in the 1830 Walton Co, GA, census
(page 158) and 1840 Walton Co, GA, census (page 120), in the
household of "Richard Upshaw", are his.
